The State attorney's office in the
Tuscan city of Spezia has requested the annulment of the birth
certificate of a child with two mothers registered by the
municipality.
Prosecutors said the birth certificate citing two mothers was
illegitimate and urged a court to rectify the situation.
The story of the child born to a same-sex couple was first
reported by the local edition of Florence daily La Nazione on
Wednesday.
A court will rule whether naming the non-biological mother as
the second parent is legitimate.
Both women, who registered a civil union at city hall, had
obtained to register the non-biological mother as the second
parent on the certificate, committing to raise together the
child.
In the absence of specific legislation, prosecutors are seeking
the birth certificate's annulment and Spezia's municipality has
announced it will defend itself in the trial, according to the
report.
