While provisionally asserting the
primacy of Italian ministers on deciding safe countries for
migrant repatriation from innovative but controversial new
processing centres in Albania, the supreme Court of Cassation on
Monday said the matter must await a ruling expected by the
European Court of Justice.
Italian courts have referred he issue to the ECJ after judging
that Egypt and Bangladesh were not safe enough for migrants to
be returned to, stymying the much trumpeted scheme.
A recent EU summit hailed the scheme and a previous ruling by
the Cassation said it was up to Italy and not a European court
to decide on it.
On Monday the high court said "there must be dialogue between
jurisdictions, and all measures are suspended".
